Mini shoots – Terms and conditions

  1. Payments. The client understands that non-refundable payment for their mini shoot is payable upon booking to secure the time slot.
  2. Cancellation. The client may cancel this contract at any time by giving written notice to the photographer, but in doing so shall forfeit any monies paid.
  3. Limitation of Liability. If the photographer is ill or injured and cannot supply the agreed services then liability is limited to a refund of any payments received and the photographer will make every effort to reschedule the mini shoot to another date in the future. The photographer will take the utmost care with respect to exposure, transportation and processing of photographs. However, in the unlikely event of the client’s photographs being lost, stolen or destroyed for reasons within or beyond the photographer’s control, liability is limited to the return of all payments received. Neither party shall be liable for indirect or consequential loss.
  4. Artistic License. The photographer is granted artistic license, and the photographer’s judgement regarding posing, lighting, locations used, photographing and editing shall be deemed correct. All decisions are made in the best interest of the client who will be given the highest quality selection from the images taken.
  5. Client conduct. The photographer will not tolerate any level of verbal abuse or aggression. Either will result in immediate suspension of services with no refund.
  6. Final images. The client will receive a gallery of edited JPEG digital images. The photographer is granted complete authority over which images are included in the final set which will be provided to the client. The client understands that no unedited images will be released. The client will be able to download all their images (at least 25 photos) from their gallery in both high and low resolution.
  7. Image editing. The photographer will edit the images to the style that the client will have seen on the photographer’s website. Any retouching requested by the client may incur an additional cost.
  8. Copyright. The client accepts that the photographer retains the copyright of all the images. The client must seek permission for use of the images beyond reproduction and printing for friends and family. The digital files remain the property of the photographer. However upon presenting the client with the files the photographer grants the client a Royalty Free license that permits the use of the images without further payment for any non-commercial lawful purpose for an indefinite period. Uses include printing and making the image available online for non-commercial use worldwide.
  9. The royalty free license does not permit the editing of the images by the clients or third parties (this includes the use of Instagram or Facebook filters). It is also prohibited to allow suppliers and third parties to use the images without the expressed written consent of the photographer and possibly the payment of appropriate fees as determined by the photographer.
  10. Force Majeure. The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
  11. Photograph delivery. The photographer aims to provide the client with their image gallery within 1 week of the shoot date. The client will then have 7 days in which to download their images and purchase any products.
  12. Display and advertising. The client allows the photographer to display any images they select from their shoot in their studios, portfolios, website, exhibitions, on social media profiles and in online and printed advertising. No use of the images will be made by the photographer for any other reason except with the written permission of the client.
  13. Complaints. Any complaints should be raised by the client with the photographer, in writing, within 28 days of first becoming aware of the matter to be complained of, and in any event, within 28 days of receipt of the images.
